CHARLES F. STALEY Of Tequesta, FL passed away July 23, 2008. He was born April 13, 1934 in Kenova, WV. He was a graduate of the University of Kentucky with a Masters Degree in Mechanical Engineering and worked as an engineer and Program Manager at Pratt & Whitney for over four decades. His dedication to his work provided timeless contributions to the many programs in developing leading edge propulsion technology - liquid rockets, jet engines, lasers and rocket engines. He is survived by his wife, Beverly; his children, Mark (Sue) Staley of North Palm Beach, FL, Terri Staley of Charlevois, MI and Scott Staley of Charlotte, ND; two grandchildren, Shaun and Dyllan of North Palm Beach; his mother, Gwen Perry of Hobe Sound; and his brother, Mike Staley of Phoenixville, PA. Chuck was a wonderful son, brother, husband, father and friend and will be greatly missed by those who loved him. A Mass of Christian Burial will be Celebrated at 10:30 AM, Monday, July 28, 2008 at St. Jude Catholic Church, 204 US Hwy. # 1, Tequesta with Very Rev. Charles Notobartola, Celebrant. Interment will follow in Roselawn Memorial Park, Tequesta. Friends are invited to meet with the family from 2-4 PM, Sunday, July 27 at the Taylor & Modeen Funeral Home, 250 Center St., Jupiter, FL. The 3 new entrance signs installed were approved by the property owners at the last General Meeting. Signs were to be in script with Waterway Village on one line and Private Roads below; no palm tree, bird or marker buoy. The Board was authorized to decide on the final design, which, after much deliberation, was approved by unanimous Board vote. It was also decided that since the Board saved $2000 on a budgeted drain repair (based on previous bids), that the gold rope was added to the signs, to keep with the overall theme of the hand painted ones by Fred Mauer. Comments have been 100% positive to date. Baron Sign is actually replacing the signs in a couple weeks due to two detail errors noted in the WVPOA Board approved design. Most notable will be the spacing between "private roads" will be increased and a slightly more oval rope look. Email comments please to LotBMan@yahoo.com.

LotBMan@yahoo.com writes: The General Meeting held April 14th had 29 Lots represented (Quorum is 20) including about a third in the form of a proxy. The meeting was chaired by Secretary Mark Bolchoz, with Linda Emerson and Chuck Staley representing the Board. Owners approved 3 new entrance signs that will have Waterway Village on one line in script, without mile marker or other artwork, similar to the one below. Total cost $3800 from Baron Sign Manufacturing, $1900 deposit already paid last November and $1900 due. Mark stated the Treasurer projected enough cash in the checking account to cover the extra spending which is not in the 2008 budget. That's okay because it was approved by the owners last evening.

The pipe on Jennie Stewart's property is scheduled for repair and is in the maintenance budget.

Rumors of the Village of Tequesta making another annexation run at Waterway Village sprung up. Former Tequesta Mayor Jim Humpage previously said PBC and Tequesta want to make annexation attractive for WV Property Owners. LotB which has its own deed would remain owned by WVPOA, Inc. PBC could potentially close its fire station on Seabrook and save a lot of money. Jim said we could expect a similar offer to the last one proposing PBC, Tequesta, WVPOA, Inc each paying a third of new roads and sewers, which could save owners $6,000 - 7,000 each, while taxes will go up as much as 15%.

Drainage issues from the shopping center need to be resolved separate of any annexation issues. Annexation would take away the common area within 30 ft west of the center of Seaview, which would reduce maintenance costs, and put the general appearance in the hands of Tequesta. It could also be used by Tequesta to manage their storm water. Much more information will be available here. Check back for updates.

WVPOA Picnic announced for later this year. $500 budgeted from WVPOA, Inc. and covered dishes from neighbors. Date TBA.

LotBMan writes: I attended the last board meeting as did Richard Bombardier, Susan Roth and ousted former board members Pagliese, Lewis and Roth who evidently were there to protest the current Boards reductions to their proposed 08 annual budget. The facilities at the Cafe Heidelberg were noisy due to no door between dining talkers. I have requested the minutes from the Secretary, Mark Bolchoz for posting here.

Oddly, the former secretary has requested minutes from meetings where she was secretary, and supposed to be taking minutes. Another "strange" thing. Why did the 2007 Board write a $300 check to a Church? It's believed to be associated with the permit for LotB? What? WVPOA is a no-for-profit corporation. We don't need a tax deduction. By the way, I understand the showers did not pass County Inspection and are thus not in use, and a waste of money on something else that was not approved by property owners. Amen. Enough fun for today. "I'll be back".....

I attended as a property owner within 300 feet and Richard Bombardier also attended as a WV property owner. The Mayor spoke of our concerns which included drainage, and traffic flow through Waterway Village. The retention pond is being expanded to hold 3 days of stormwater from the bank lot. Traffic is being directed via a curb design with signs forcing departing traffic west on Cove Road from the 4 drive-thru tellers. The Mayor hinted that Tequesta's finest would issue a citation for illegal right turn from the bank teller lanes onto Cove Rd. Sidewalks are also being installed along the South side of Cove Rd. Demolition of the Citgo and carwash will begin soon. The bank is projected to generate 214 fewer customer visits per week than the Citgo. The bank will be open fewer hours 7 days a week.

LotBMan@yahoo.com writes: Highlights from (12/11/07) last evening's board meeting included election of officers. President George Arp, Secretary Mark Bolchoz, Treasurer Nancy Johnson, 1st V.P. Chuck Staley, Directors Linda Emerson and Tom Somerville.

The new board proceeded to slash the proposed budget from $660 to $300, eliminating items such as a proposed $8010 property manager, $8900 in reserves and a $7500 new fence at LotB. The Board decided to repair the fence, including new gates and lock box for $1800. $500 was included for a Spring picnic at LotB. A Special Meeting is being planned per a forthcoming announcement from the new Board. Next Board meeting is Jan. 8.

WV property owners are urged to mail in their $300 (total) per lot annual assessment right away in order to cover 2008 expenses.

Mike I don't know if is your place to be the conduit between the Board and the Property Owners. I also don't think it is your place to distribute the Board's decision's or information to the Property Owners by way of your own personnel e-mail. Your personnel web site is Not and has NEVER been approved by the Property Owners Assoc. to be the official web site. As of this date WVPOA DOES NOT HAVE an OFFICIAL APPROVED WEB-SITE.

I will bring up at this time something that I had brought to the Boards attention this past year. The storm water pipe located on my property line to the north has been leaking and has created a large sink hole between my house and my neighbor's house down toward the water. I was told in a brush off comment by the BOARD that my neighbor Jenny and myself should get the problem repaired and submit a bill to the WVPOA for reimburstment. I know that is not our place to have such problems fixed. Since the drain system was installed by the WVPOA several years ago and it is the WVPOA responsibility to maintain. And now it is a very serious and dangerous problem. I would like to know when this Board is going to get this fixed. thanks JOHN KENDALL

You can always mail in the $660 and get a refund after the final assessment amount is determined, or send $250 knowing the Board is trying to budget closer to $250 than $660. The new budget will be approved at the next special general meeting, but everyone should receive an advance copy by mail. From what I gleaned from the meeting there is roughly $7500 in the checking account, with a dozen $100 assessments unpaid and untold number of annual $250-660 due.
The P O Box had not been checked since before Thanksgiving and may contain more checks.

In my opinion, WVPOA has a talented diverse Board that is open and honest. WV owners will either reelect them or replace them in Nov 2008 per majority vote.

Also everyone living in Waterway should have input on the entrance way signs, not just Property owner Tony Rodriques. Nothing against Tony, it's just not his call. I think the Board should meet and finalize a Budget on Dec 11th. Then they have time to do a Mailer to all home owners.
what you want done is not by the rules, that everybody is required to send in a payment of $250.without an approved budget. FYI John Kendall

5 new Board members were present (Staley, Bolchoz, Bombardier, Emerson, Johnson), 2 new members Somerville and Arp were absent. Previous Board member Barbara Lewis (Secretary and acting Treasurer) turned over a small amount of information to the Board and new acting Treasurer Nancy Johnson. Ms. Lewis has possession of all WVPOA archives and safe deposit box materials in her garage.
Currently WVPOA does not have a safe deposit box.

Mike Steinbrook was also present representing owners within 300 ft of the Proposed Commerce Bank at Cove and U S One. He presented a design board of the building and discussed pending traffic flow issues that could impact Waterway Village. FDOT has completed its study. The final site plan approval meeting is scheduled for Dec 13 at Tequesta Village Hall at 7:00 PM. All Waterway Village Property Owners are invited to attend and support and protect our community. The more people who show up the better.

The following is a brief summary of the rest of the meeting.

The Board Members decided to hold its Officer vote at the next meeting Dec 11, 2007 (same location) when a full 7 member attendance is expected. Also at that meeting an amended/reduced 2008 budget is anticipated. In the meantime, the Board is requesting that all owners send in $250. (same as last year) and if additional funds are needed, owners will be notified. A letter from the Board is forthcoming, though it may be after the Dec. 11 Board meeting.

Baron Signs has a 50% deposit for 3 new entrance signs that have yet to be approved by WV owners. Linda Emerson is following up to see the status if we choose other options, or fewer signs. It was mentioned that Tony Rodrigues would like the WV sign in his yard removed (corner Basin/Waterway).

(1) A corporation shall keep as records minutes of all meetings of its members and board of directors, a record of all actions taken by the members or board of directors without a meeting, and a record of all actions taken by a committee of the board of directors in place of the board of directors on behalf of the corporation.

(2) A corporation shall maintain accurate accounting records.

(3) A corporation or its agent shall maintain a record of its members in a form that permits preparation of a list of the names and addresses of all members in alphabetical order by class of voting members.

(4) A corporation shall maintain its records in written form or in another form capable of conversion into written form within a reasonable time.

(5) A corporation shall keep a copy of the following records:

(a) Its articles or restated articles of incorporation and all amendments to them currently in effect.

(b) Its bylaws or restated bylaws and all amendments to them currently in effect.

(c) The minutes of all members' meetings and records of all action taken by members without a meeting for the past 3 years.

The fishing pier north safety light (Required by law) was replaced by Richard Bombardier 8/16/07. The stolen solar light was a known safety hazzard for more than a year, and only cost $152.96 to replace.
We had difficulty exiting Lot B because the gate lock was jammed.

Eight teenagers were gathered on the fishing pier Wednesday evening 8/15/07. Though there was underage drinking going on, the observer chose not to call PBSO.

LotBMan writes: The Board continues to use an "expensive" unlicensed/uninsured irrigation person, Walter (who wants to charge us $940 for trenching, in the sand, for a one inch electric conduit line from the light pole to the picnic shelter), to do other miscellaneous work in Waterway Village. All work is to be performed by Licensed/Insured contractors, with multiple bids, when adding an improvement approved by owners, or for replacement of 6 expensive trees caused by Hurricane damage. The oak trees cost $175 each when originally planted by Kendall's buddy. The tababouias were less expensive.

In reading the Board meeting minutes it is clear the Board members are not current with County Code for plumbing work, or even know the difference between irrigation and plumbing. A County issued permit includes ADA compliance, so all property owners can use any proposed shower at Lot B, whether they use a walker, or wheelchair to get to the shower. By the way, No shower has ever been approved by property owners. No irrigation timer for Lot B has ever been approved by property owners. No water line to the fishing pier has ever been approved by property owners. No dome light or flood lights have been approved for the picnic shelter. The current Board is spending money like drunken sailors, on unapproved projects. What's the deal about the proposed $600 trash can for lot B? This wasteful spending is beyoud belief. There was no need for the $100 SPECIAL ASSESSMENT, which has never been done without owner approval in the history of Waterway Village. The budget mailing and annual assessment should be mailed in September, and with over $8000 left in the checking account, there was no need to "panic" and impose an unneeded assessment for unappropriated spending on MORE UNAPPROVED PROJECTS!

Feb - June 2007 minutes is a start. It would be helpful if we could read the previous period from Nov 2005 to Nov 2006 official minutes, especially the General Meeting Minutes. That's where motions were made and votes cast. We will gladly transcribe copies or faxes if necessary. Once WVPOA has an Official site, we can link to it, and the Board can post the minutes, announcements, agendas and news. That will be great. Until then, this is totally free, and the most current facts about our community. New owners need to see what's going on in Waterway Village.

LotBMan: writes: The minutes posted above present some compelling reading for all property owners in Waterway Village. We have an electrician bid for the Lot B electric work of $1100 including the trenching, plus permit and FPL meter. The electrician is Jim Humpage AKA Mayor of Tequesta, same great guy. Why does the Board plan to spend/waste over $2000 more for the same work? Was the Board "embelishing" the facts, with add ons or misappropriating and depleting the property owners' cash. Jim Humpage never got a call from Paul. Why Paul? I gave you Jim's electrician and mayor telephone numbers. $940 for trenching by the unlicensed/uninsured irrigation guy? For a ine inch conduit line, that's too damn expensive! The licensed/insured electrician is cheaper. The current Board is spending money foolishly!.
Furthermore, it is clear that the present Board is anti-ADA, and not considerate of the many disabled individuals in Waterway Village. This is totally unexceptable. People other than me, others with walkers, wheelchairs or who can't walk far because of illness, should have equal access to any shower provided to other able-bodied owners of Lot B. If the shower remains where it is, as I was told by PBC, it will have to be made accessible by Code, period, to be issued a permit.

Michael Steinbrook and Richard Bombardier met with the Tequesta Police Department on 08/06/07 and presented recommended changes for the proposed Commerce Bank dealing with public safety and expressing concerns regarding bank traffic flow onto Cove Road and potentially through Waterway Village. The Department spokesman, Capt. Rick Ricciardi agreed that the "well thought out plan" which would direct drive thru customers to exit on U.S. One instead of onto Cove Road, should be adopted before he and the Fire Chief would sign off on the project. Owners of the six WV lots and Coconut Cove will follow through with Tequesta officials until the final approval stage of the project is reached. All Waterway Village property owners should consider attending these meetings. It could help when it comes time to consider other issues, especially stormwater. Property owners within 300 feet of the Citgo Station were notified of a proposed Commerce Bank for the site. All owners of the six WV lots involved lots (Lots 1,2,3,4,16,17), have provided input and support in protecting Waterway Village concerning increases in traffic through our private community, drainage from the site, privacy and safety. Chuck Staley, Nancy Johnson and Michael Steinbrook, owners of lots 3,4,16,17 attended the meeting. Steinbrook and Staley spoke on behalf of the properties involved and will attend the follow up meetings.

The Coconut Cove POA sent a support letter welcoming the new bank and did not attend the meeting, or offer any suggestions, at the meeting. That car wash was noisy, and except for the occasional hold up, the bank will be much quieter, LOL. WVPOA had two directors in attendance who supported traffic safety and drainage issues.

We hope to use this window of opportunity to pitch our drainage case regarding stormwater from Cove Road (both sides) as well as protecting our community from cut-through traffic from the bank. We are suggesting a change in traffic flow to route exiting bank customers onto U.S. One instead of Cove Road, as currently planned. The proposed plan exits onto Cove Road with a No Right Turn sign.


Culvert on Seaview between Cove and Pebble is filling our swale with stormwater being pumped from the shopping center. This polluted stormwater crosses Seaview and flows down Cove Road into the Intracoastal Waterway at Lot B. Last year, the shopping center owners paid $6150. tax for Tequesta Stormwater management. Is dumping the water on Waterway Village managing the shopping center's stormwater properly?

Example: No flood lights were approved for Lot B, only electric service on a timer, to the picnic shelter. No flood lights are needed. Early this morning (Sat) my wife saw three youngsters (unknown) swinging on Lot B Gate; using it like a swing. Then, they slammed it shut and kicked it open a few times. They left before we could contact them.

WHEN WILL THE LOT B GATE GET FIXED? I thought the Board was hiring a "repair/maintenance" person to do the minor repairs around the village. Am I correct? If not, please let me know and I'll arrange to have the gate fixed.

Pending WVPOA Board Projects:
At the Spring 2006 Meeting WV property owners approved the installation of a water meter and electric service for the picnic shelter, with a budgeted amount of $6500. Water meter is installed.

April 2007
On April 18, 2007 WVPOA, Inc. filed an Amended Annual Report for 2007 with the State of Florida.

Waterway Village Property Owners Association aka
WVPOA Inc. held a meeting April 5, 2007. The current President denied access to an invited disabled property owner and failed to notify all Board members or property owners of the meeting date, place and time.

2 showers and a fish cleaning station were installed at Lot B, without a required permit, and without property owner approval. This project calls for a licensed plumber, not an unlicensed sprinkler repairman.
PBC Code Enforcement is working on getting it up to Code.

March 2007
Hurricane damage restoration was finally completed along Seaview, with help from PBC. Seaview Road looks a lot better. The Rain Bird irrigation timer was replaced with a Hunter timer.

98 extra ficus bushes were planted on Shopping Center property by the WVPOA Board. An unlicensed, uninsured irrigation repairman was instructed to tie the Seaview irrigation system to feed the shopping center's irrigation lines, on their property, without their knowledge or authorization.

An inaccurate 2007 Annual Report was signed (3/6/07) and filed "under oath" with the Florida Secretary of State March 9, 2007. Non-Board members were listed, and other Board members' names were omitted.

Sweet and Knapp resign Board
ResigningTreasurer Jim McGrath was replaced by Carl Moritz.
Resigning Secretary Bruce Sweet was replaced by the appointment of Barbara Lewis, who is a lot owner, but not a resident of Waterway Village. Somehow, John Kendall was appointed to the Board, and elected President by the other Board members. This action destroyed the diverse makeup of the 7 member Board nominated and duly elected by the property owners at the November 2006 General meeting.
